General Terms and Conditions of Online Sales of Swedishop® Sarl.

This website is the full property of the company Sarl Swedishop®, including all pending rights. Any reproduction is subject to the written authorization of the owners.


1. Preamble

SWEDISHOP® specifies that its online sales are reserved for non-merchant, natural persons of adult age who purchase for their own non-professional needs and for legal entities buying for their non-professional needs, who accept to fill in the mandatory registration fields and whose delivery address is located within SWEDISHOP® delivery areas.

The present general and specific sales terms and conditions peculiar to each article offered on the websites SWEDISHOP.com, SWEDISHOP.fr and SWEDISHOP.eu (hereinafter referred to as “the website") govern the relations between the company SWEDISHOP® (S.A.R.L., French limited liability company with a capital of 2.500 €), based in Le Ban-Saint-Martin (57050, FRANCE), 7 rue Jeanne d'Arc, registered in the Registre du commerce et des sociétés de Metz under the number RCS METZ TI 500 737 002, identified under intra-community VAT Nr. FR51500737002 and the customers of the website, excluding all other conditions.


2. Acceptance of general and specific sales terms and conditions
Any confirmation by the customer of an order placed by them through the website signifies agreement by the customer to the present general sales terms and conditions of SWEDISHOP® and to the specific sales terms and conditions specificr to their order (articles ordered as presented on the website subject to availability where specified, specifications, price, components, etc.). Prior to this confirmation, the customer may correct or modify their selection. This possibility of change is accessible at each stage of the ordering process.


3. Products

A brief description is given for all articles available on the website, including specification, quantity and price details.

The pictures illustrating the products are not contractual and merely provide a general presentation of the products. SWEDISHOP assumes no responsibility for any error regarding photos. Regarding all gift packs: if ever a product is temporarily missing, this product will be replaced in the gift pack by an equivalent product and of same value.



4. Duration of the offer

Our offers are valid only for the duration of their presentation online and subject to availability. In the event a product is not available after the customer has placed their order, we will contact the customer as soon as possible, either by phone or by email, to inform them and agree to:

- postpone delivery until the product is in stock, when this is possible,

- substitute the product with a product similar in price and quality; in the event of a return of such product, return costs will be borne by SWEDISHOP®,

- cancel the customer’s order and reimburse the amount paid, in accordance with conditions and terms defined hereafter in article 10.


5. User name and password

Upon first order the customer chooses a user name and a password. The user name and password ascertain the customer’s identity and commit them on all orders placed using these name and password, which are equivalent to an electronic signature as defined in the law of March 13, 2000.


The customer is sole responsible for their user name and password. The customer bears alone the consequences that may result from any use by third parties aware of these user name and password, unless the customer can prove that knowledge of their user name and password is the consequence of an error committed by SWEDISHOP®.


Should the customer forget their user name and password or fear that a third party may be aware of these, on the website they have at their disposal a function that enables them to recover their user name and choose a new password.


6. Formation of the contract: operating mode and evidence


6.1 Entering and confirming the order

The complete order appears prior to confirmation by the customer, who must then specify the delivery address and the means of payment. The customer is then asked to validate the order. Once this operation has been completed the order is automatically entered and becomes binding, subject to the following paragraph.

When the customer places an order with payment by bankcard or credit card, the order is effective only when all payment centers involved have given their approval. Should these payment centers refuse payment, the order is automatically cancelled, and the payment center informs the customer via a message on the screen.


6.2 Acknowledging receipt of the order

SWEDISHOP® acknowledges receipt of customer’s order. This confirmation, sent to the customer by electronic mail, lists the goods ordered, the delivery address, the method of payment (online or by check) and provides an order number.

The information provided by the customer upon placing the order is binding: in the event the customer makes a mistake when entering their details or the details of the delivery address, i.e. first name, surname, address, telephone number, email address, building entrance code, floor, causing loss of the products, the customer remains bound to pay for lost goods.


6.3 Proof

The automatic recording systems of SWEDISHOP® websites are deemed to be proof of the nature, content and date of (i) the customer’s order, of (ii) the acknowledgement of receipt of the order by SWEDISHOP® and of (iii) all electronic mail exchanged between SWEDISHOP® and the customer.

Information pertaining to an operation performed from the user name will be stored and filed by SWEDISHOP® and will serve as proof in the event of a dispute with the customer, in accordance with the law of March 13, 2000 on electronic signature and electronic proof. This information will have probative value in the event of a dispute between the parties and will be kept by SWEDISHOP® for an unlimited duration.


7. Price

Prices are expressed in euros. The prices listed on the product sheets do not include delivery costs. Delivery costs are indicated to the customer on the website before they confirm the order.

The total amount inclusive of tax (TTC) appearing on the order confirmation is the total amount of the order placed on the website expressed inclusive of all tax and includes VAT. This amount includes the cost of products and transportation costs.


8. Payment

During the order process the customer chooses to pay by bankcard, credit card or bank transfer (no check accepted for foreign coutries outside France). If the customer chooses to pay by bankcard or by credit card, they are redirected to the secure website of our banking partner CIC, which ensures data confidentiality for cardholders via protection and encryption procedures.

If the customer chooses to pay by bank transfer it has to be made to our SWEDISHOP® account, all details are provided on the website including IBAN and SWIFT codes, the customer will need to mention the order reference and his name on the transfer for easier identification.
The invoice will be included in the parcel unless the delivery address is different from the invoicing address (e.g. for gifts). In such event the invoice will be sent by mail to the invoicing address.


9. Delivery


9.1 Conditions

The goods ordered will be sent once full payment for goods and transportation has reached SWEDISHOP®. SWEDISHOP® reserves the right to cancel an order that has not been paid in full within 15 days of the date of the order.

All events considered as force majeure events, such as war, civil war, fire, strike, impossibility to be supplied with raw materials, stoppage of transportation that may delay, prevent or render supplying exorbitant, constitute, by express agreement, a legitimate motive for suspension or extinction of SWEDISHOP®’s obligations, without any compensation for the customer should the event last over a period of fifteen (15) days.

SWEDISHOP® shall inform the customer, by all appropriate means, of the existence of such event in order to enable the customer to withdraw their order by simply writing to SWEDISHOP®.

In the event the goods ordered have not been delivered within thirty* (30) days of receipt of customer’s payment by SWEDISHOP®, for any reason other than a force majeure event, the customer may cancel their order. In such event the customer will be reimbursed immediately (* unless agreed otherwise).
Swedishop can not be made responsible for delays caused by third parties such as customs services in foreign countries.

9.2 Costs

Delivery costs are calculated automatically during the order process and appear on the complete order page with prices, prior to final validation by the customer. Swedishop can not be made responsible or charged, for any customs costs that would arise in certain countries.

9.3 Details

For deliveries occurring within the areas specified on the website, delivery will be made by “express postal service” in France and in all countries where this transportation mode exists. For deliveries to other countries the goods will be sent through the post, unless otherwise requested by the customer.

For deliveries occurring outside the EU, the customer agrees to pay all taxes applied to the import of goods and claimed upon delivery of the goods, i.e. customs duties, value added tax an/or any other tax owed in accordance with the laws of the country where the goods shall be delivered. SWEDISHOP® denies any legal responsibility for non-payment of such taxes by the customer.

The delivery is considered complete from the moment the goods ordered by the customer have been handed over by SWEDISHOP® to the carrier. The goods travel at the customer’s own risk, even when the goods are sent to another recipient, as the risks for loss and damage to the goods are transferred when the goods are handed over to the carrier. The customer must verify the condition of the goods upon receipt and, in the event of lost or damaged goods, make express reservations with the carrier by registered letter with acknowledgement of receipt within 72 hours of delivery.  SWEDISHOP® reserves itself the right to use other carriers for specific deliveries. Final decision upon the carrier is made by Swedishop.


In the event of nonconformity or apparent defect on the goods delivered, the customer can lodge a complaint with SWEDISHOP® within seven (7) days of receipt of such goods, in writing (by mail, electronic mail or fax). After this deadline the goods delivered are considered compliant and without apparent defects.


10. Guarantee: satisfaction or your money back

In accordance with the provisions of article L. 121-16 of the French Code de la consommation, the customer has a seven (7) day period of reflection after receipt of the goods ordered, and may return these goods to SWEDISHOP® at the following address: 7 rue Jeanne d'Arc, 57050 Le-Ban-Saint-Martin.

If this seven-day period of reflection expires on a Saturday, a Sunday or a public holiday, it is extended to the following working day.

In the event the customer exercises their right to give up their purchase, SWEDISHOP® will reimburse the amount paid for the goods in question, except for return costs, within thirty days of receipt of returned goods, by wire transfer or by check. This period of reflection does not, however, apply to perishable goods (Delicatessen) and does not apply to products which are manufactured to the order (furniture...).


11. Goods compliance guarantee

The customer shall benefit from the legal guarantee for latent defects of the products sold. Provided the buyer proves latent defect, SWEDISHOP®, the seller, is legally obliged to repair all consequences of such defect. If the buyer goes to court, he or she must do so within a “short period” as from the discovery of the latent defect (Article 1648 of the French Civil Code).


12. Customer services

13. Personal information

Upon ordering on the SWEDISHOP® website, the customer agrees to the use of the personal data provided by them or collected through the website. This information is essential for processing the orders.

In accordance with the provisions of the French “Computing and Liberties law” (nb 78-17 of January 6 1978), SWEDISHOP® has notified the processing of personal information relating to customers to the French Data Protection Authority (CNIL). The customer has the right to access, correct or remove their personal data. In order to exercise this right, the customer may either choose this online when registering, or send their request to: SWEDISHOP® - 7, rue Jeanne d'Arc, 57050 Le-Ban-Saint-Martin.

Our customers may receive commercial propositions from other companies through SWEDISHOP. Unless the customer opposes this, SWEDISHOP® may (i) sell the data (except for email addresses) collected to any third party, (ii) use the customer’s email address to inform them on SWEDISHOP® products and services.


14. Liability

Unless an error on their part can be proven, SWEDISHOP® will not be liable for any material or physical damage, which may result from improper use of the user name, or of the ordering process. In particular, SWEDISHOP® will not be liable for any risk inherent to the use of the Internet, such as a suspension of service, an intrusion or the presence of a computer virus.


15. Modification

The parties agree that SWEDISHOP® may, at its own right, modify its service without any other formality than an online notification to customers during one month and an amendment to the General Terms and Conditions if appropriate. SWEDISHOP® invites its customers to carefully read the current General Terms and Conditions at each new order.


16. Protection of Minors

In accordance with the provisions of article L. 3342-1 of the French Code of Public Health, sales of alcohol to minors under 16 years of age is forbidden. Any person ordering on the website must therefore be of legal drinking age.


17. Disputes

The present General Terms and Conditions and all operations mentioned in these are subject to French law. In the event of a dispute, the customer will first contact SWEDISHOP® to seek an amicable solution. Failing such amicable solution, the parties will expressly refer to the competent court of law in the jurisdiction concerned, which is Metz in France.

18. Others
As a responsible entrepreneurial company, Swedishop insists on some aspects of the Terms & Conditions, and more precisely:

18.1/ by definition we can not control the age of our customers so we must assume and take for granted that our customers have the required legal age to buy (& consume) alcoholic products

18.2./ if some of the products offered are very specific, we try to explain these specifics through a very precise product description on our website.

18.3: as far as the outdoor candles are concerned, these products are always delivered with "instructions for use" in English language. This document is available in English & French and is available on request by email. This document lists all major necessary precautions for the use of the outdoor candles available on the website. This document is always put in the box, with every order, on top of all other documents so the customer sees it directly. These instructions must be taken into consideration while using the outdoor candles. By validating our terms & conditions the customer confirms he will use the outdoor candles according to these instructions for use.
